AI assessment rules and implementation
California’s Government Operations Agency receives duties under the enacted SB813 and AB1405 laws: independent-verifier criteria due by January 2028, and an auditor registry by January 2029.
California's Government Operations Agency becomes an important implementation body under two laws signed on September 9, 2026. SB813 assigns it the development of criteria for independent verification organizations by January 2028. AB1405 requires an AI-auditor registry by January 2029. Those are future implementation duties attached to enacted legislation.
The agency will help decide what qualifies an assessor to perform these roles. SB813 requires attention to expertise, independence and conflicts, with working groups that include engineers from competing AI companies and AI-safety experts. AB1405 adds registration administration, a misconduct-reporting channel and powers concerning removal and referrals. The criteria and the people contributing to them are consequential parts of the design.
