Senate roll call 234 records a September 15 vote of 49–50 rejecting cloture on the motion to proceed to H.R. 3633. It required three-fifths. This was not final passage.

The floor record records Thom Tillis entering reconsideration. Permanent defeat is therefore not established. Our September 14 draft analysis describes proposed intervention and ethics provisions, not powers that came into force.

Tim Scott's response calls for SEC and CFTC rulemaking while Congress remains unable to legislate. That is a declared alternative strategy; it neither expands agency authority nor proves adoption of a rule.

The next test is reconsideration or revised legislation, followed separately by actual agency proposals and their claimed statutory basis. Political sponsorship did not supply the votes needed at this stage.
